Removal Orders
Removal orders are issued by the Canada Border Services Agency (CBSA) or Immigration, Refugees and Citizenship Canada (IRCC) when a foreign national or permanent resident is found inadmissible to Canada under the Immigration and Refugee Protection Act (IRPA). There are three types of removal orders:
Departure Order
You must leave Canada within 30 days and confirm your departure with CBSA. If you fail to do so, it automatically becomes a Deportation Order.
Exclusion Order
You cannot return to Canada for 12 months unless you obtain an Authorization to Return to Canada (ARC). If the exclusion is due to misrepresentation, the ban is for 5 years.
Deportation Order
You are permanently barred from returning to Canada unless you obtain an Authorization to Return to Canada (ARC). This is the most serious type of removal order.
A Removal Order in Canada requires the individual to leave the country within the stipulated time. Many times, individuals may fear returning to their home country due to reasons like security threats or other risks. In that scenario, the person can submit an application known as Pre-Removal Risk Assessment (PRRA) to the concerned authority. A PRRA will ascertain the risks the individual may face back home and take the necessary decision.
